Terms of Service

1. Agreement to Terms

By accessing or using ModBinder ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ModBinder is a subscription web application for tracking vehicle modifications, maintenance records, receipts, dyno sheets, and related documents. The Service allows users to organize vehicle build information, track spending, store photos and documents, and optionally share their builds publicly.

3. Account Terms

To use ModBinder, you must:

  • Be at least 18 years of age
  • Create only one account per person
  • Provide accurate information when creating your account
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or illegal behavior.

4. Subscription Terms

Pricing

ModBinder Pro is available for $3.99 per month or $39.99 per year. Prices are in US dollars and may be subject to change with notice.

Free Trial

New subscribers receive a 7-day free trial. Payment information is required upfront to start the trial. You will be automatically charged when your trial ends unless you cancel before the trial period expires.

Billing

Subscriptions are billed monthly on the same day you subscribed. Your subscription will automatically renew each month until you cancel.

Cancellation

You may cancel your subscription at any time through your account settings. When you cancel, you will retain access to the Service until the end of your current billing period. After that, your access to premium features will end.

Refunds

We do not provide refunds for partial months of service. If you cancel mid-month, you will continue to have access until the end of that billing period but will not receive a prorated refund.

5. User Content

Ownership

You retain full ownership of all content you upload to ModBinder, including but not limited to vehicle information, modification details, photos, receipts, documents, and any other data you provide.

License to Us

By uploading content to ModBinder, you grant us a non-exclusive, worldwide license to store, display, and process your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or account.

Your Responsibility

You are responsible for ensuring you have the necessary rights to any content you upload. Do not upload content that infringes on others' intellectual property rights, contains sensitive personal information of others without their consent, or violates any applicable laws.

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload malware, viruses, or any harmful code or files
  • Attempt to hack, disrupt, or gain unauthorized access to our systems or other users' accounts
  • Use automated scripts, bots, or scrapers to access the Service or collect data
  • Impersonate any person or entity, or misrepresent your affiliation
  • Harass, abuse, or harm other users
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to circumvent any security features or access restrictions

7. Service Availability

We strive to keep ModBinder available and functioning properly at all times. However, we cannot guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any features of the Service at any time. We will make reasonable efforts to provide advance notice of significant changes that may affect your use of the Service.

8. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We take reasonable measures to protect your data, but we are not responsible for any loss of data, though we make every effort to prevent such loss. You are encouraged to maintain your own backups of important information.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MODBINDER AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

By You

You may delete your account at any time through your account settings. Deleting your account will cancel your subscription and permanently delete all your data, including vehicles, modifications, photos, documents, and files. This action cannot be undone.

By Us

We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in behavior that is harmful to other users, our systems, or the Service. We will make reasonable efforts to notify you before termination unless immediate action is required.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by email or through a notice in the Service. Your continued use of ModBinder after such changes constitutes acceptance of the updated terms.

We encourage you to review these terms periodically to stay informed of any updates.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.
